Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both insightful (...) and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making. Second, at a minimum it points out serious pitfalls for analytical or empirical studies of juridical proof. (shrink)

Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

Monetary Intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. I propose a framework, derived from moral theory, for assessing the moral status of intelligent machines. Using this framework, I claim that some current and foreseeable intelligent machines have approximately as much moral status as plants, trees, and other environmental entities. This claim raises the question: what obligations could a moral agent (e.g., a normal adult human) have toward an intelligent machine? I propose that the threshold for any moral obligation should be the "functional morality" of Wallach and Allen (...) [20], while the upper limit of our obligations should not exceed the upper limit of our obligations toward plants, trees, and other environmental entities. (shrink)

Some types of solar radiation management (SRM) research are ethically problematic because they expose persons, animals, and ecosystems to significant risks. In our earlier work, we argued for ethical norms for SRM research based on norms for biomedical research. Biomedical researchers may not conduct research on persons without their consent, but universal consent is impractical for SRM research. We argue that instead of requiring universal consent, ethical norms for SRM research require only political legitimacy in decision-making about global SRM trials. (...) Using Allen Buchanan & Robert Keohane's model of global political legitimacy, we examine several existing global institutions as possible analogues for a politically legitimate SRM decision-making body. Must we choose between reducing material substances to collections of properties, a’ la Berkeley and Hume or positing bare particulars, in the manner of Locke? Having repudiated the notion that a substance could simply be a collection of properties existing on their own, is there a viable alternative to the Lockean notion of a substratum, a being essentially devoid of character? E.J. Lowe and Michael Loux would answer here in the affirmative. Both recommend hylomorphism as an upgrade on the (...) metaphysics of the British empiricists: treating a material substance as its essential 'form,' this embodied 'substance' universal being, in turn, the substratum in which its 'accidents' inhere. Here, I evaluate this Aristotelian metaphysics, identifying the advantages it enjoys over the empiricist's alternatives pertaining to dependence, unity, identity, change, and the distinction between essential and accidental properties. In a series of essays David Gauthier develops a two-tier pragmatic theory of practical rationality and argues, within that theory, for a distinctive account of the rationality of following through with prior assurances or threats. His discussion suggests that certain kinds of temporally extended agency play a special role in one’s temporally extended life going well. I argue that a related idea about diachronic self-governance puts us in a position to explain a sense in which an accepted deliberative standard can (...) be self-reinforcing. Minimizing the costs that others impose upon oneself and upon those in whom one has a fitness stake, such as kin and allies, is a key adaptive problem for many organisms. Our ancestors regularly faced such adaptive problems (including homicide, bodily harm, theft, mate poaching, cuckoldry, reputational damage, sexual aggression, and the infliction of these costs on one's offspring, mates, coalition partners, or friends). One solution to this problem is to impose retaliatory costs on an aggressor so that the aggressor (...) and other observers will lower their estimates of the net benefits to be gained from exploiting the retaliator in the future. We posit that humans have an evolved cognitive system that implements this strategy – deterrence – which we conceptualize as a revenge system. The revenge system produces a second adaptive problem: losing downstream gains from the individual on whom retaliatory costs have been imposed. We posit, consequently, a subsidiary computational system designed to restore particular relationships after cost-imposing interactions by inhibiting revenge and motivating behaviors that signal benevolence for the harmdoer. The operation of these systems depends on estimating the risk of future exploitation by the harmdoer and the expected future value of the relationship with the harmdoer. We review empirical evidence regarding the operation of these systems, discuss the causes of cultural and individual differences in their outputs, and sketch their computational architecture. Thus far, we know much more about the significant outcomes of perceived ethical leadership than we do about its antecedents. In this study, we focus on multiple types of ethical role models as antecedents of perceived ethical leadership. According to social learning theory, role models facilitate the acquisition of moral and other types of behavior. Yet, we do not know whether having had ethical role models influences follower perceptions of one’s ethical leadership and, if so, what kinds of role models (...) are important. We conducted a field study, surveying supervisors and their subordinates to examine the relationship between three types of ethical role models and ethical leadership: the leader’s childhood role models, career mentors, and top managers. We found that having had an ethical role model during the leader’s career was positively related to subordinate-rated ethical leadership. As expected, this effect was moderated by leader age, such that the relationship between career mentoring and ethical leadership was stronger for older leaders. Leader age also moderated the relationship between childhood models and ethical leadership ratings, such that having had childhood ethical role models was more strongly and positively related to ethical leadership for younger leaders. We found no effect for top management ethical role models. Implications for research and practice are discussed. (shrink)

We are purposive agents; but we—adult humans in a broadly modern world—are more than that. We are reflective about our motivation. We form prior plans and policies that organize our activity over time. And we see ourselves as agents who persist over time and who begin, develop, and then complete temporally extended activities and projects. Any reasonably complete theory of human action will need in some way to advert to this trio of features—to our reflectiveness, our planfulness, and our conception (...) of our agency as temporally extended. These are, further, features that have great significance for the kinds of lives we can live. For these two reasons I will say that these are among the core features of human agency. A theory of human action needs to say what these core features consist in and how they are related to each other. And such a theory needs also to clarify the relation between these core features of our agency and the possibility that we are fully embedded in an event causal order. (shrink)

Während beispielsweise kein Zweifel daran besteht, dass wir üblicherweise unsere Eltern und zeitgleich etwaige Geschwister sowie umgekehrt Eltern für gewöhnlich alle ihre Kinder lieben und wir zudem zumeist mehrere enge und tiefe Freundschaften pflegen, ist die gesellschaftlich vorherrschende Auffassung von romantischer Liebe weitgehend von der Idee geprägt, dass es sich ausschließlich um exklusive Zweierbeziehungen (...) handeln könne. Darüber hinaus haftet allen von der romantischen exklusiven Paarbeziehung abweichenden Formen, Liebe in Beziehungskonstellationen zu leben, eine diese moralisch mindestens als implizit fragwürdig, wenn nicht sogar offen als verwerflich kennzeichnende Be- beziehungsweise Verurteilung an. Tatsächlich gibt es allerdings viele Alternativen zur Monogamie. Der vermutlich berühmtesten, der Polyamorie, widmet sich der vorliegende Schwerpunkt. Das Wort „Polyamorie“ ist ein griechisch-lateinischer Hybrid (griech. polýs, viel/mehrere; lat. amor, Liebe) und die Bezeichnung für das zeitgleiche und konsensuelle Eingehen mehrerer Liebesbeziehungen. „Polycule“ ist das englische Kunstwort für eine ganze Reihe deutscher Ausdrücke für polyamore Beziehungsmodelle wie etwa auch „konsensuell- nichtmonogames Beziehungsnetzwerk“, „Sorgegemeinschaft“, „Wahlfamilie“ oder „Polykül“. Polyamore Beziehungsmodelle sind demnach breit gefächert und können letztlich alle möglichen Beziehungskonstellationen zwischen Personen umfassen, die einander auf die eine oder andere liebende Weise nahestehen. Dieser Schwerpunkt wirft vereinzelt Schlaglichter der philosophischen und ethischen Reflexion auf einige der Fragen und Herausforderungen, die sich hinsichtlich ethischer Polyamorie stellen beziehungsweise die mit dieser Form der nichtmonogamen Beziehungspraxis und -haltung einhergehen. Unsere Autor*innen eröffnen Diskussionsräume über einige grundlegende Aspekte einer Auseinandersetzung mit dem Phänomen der Polyamorie. In this response, we address eight issues concerning our proposal that human minds contain adaptations for revenge and forgiveness. Specifically, we discuss (a) the inferences that are and are not licensed by patterns of contemporary behavioral data in the context of the adaptationist approach; (b) the theoretical pitfalls of conflating proximate and ultimate causation; (c) the role of development in the production of adaptations; (d) the implications of proposing that the brain's cognitive systems are fundamentally computational in nature; (e) our (...) preferred method for considering the role of individual differences in computational systems; (f) applications of our proposal to understanding conflicts between groups; (g) the possible implications of our views for understanding the operation of contemporary criminal justice systems; and (h) the question of whether people ever “genuinely” forgive. Cases of modest sociality are cases of small scale shared intentional agency in the absence of asymmetric authority relations. I seek a conceptual framework that adequately supports our theorizing about such modest sociality. I want to understand what in the world constitutes such modest sociality. I seek an understanding of the kinds of normativity that are central to modest sociality. And throughout we need to keep track of the relations—conceptual, metaphysical, normative—between individual agency and modest sociality. In pursuit of these (...) theoretical aims, I propose that a central phenomenon is shared intention. I argue that an adequate understanding of the distinctiveness of the intentions of individuals allows us to provide a construction of attitudes of the participants, and of relevant inter-relations and contexts that constitutes shared intention. I explain how shared intention, so understood, differs from a simple equilibrium within common knowledge. And I briefly contrast my views with aspects of views of John Searle and Margaret Gilbert. Although computation and the science of physical systems would appear to be unrelated, there are a number of ways in which computational and physical concepts can be brought together in ways that illuminate both. This volume examines fundamental questions which connect scholars from both disciplines: is the universe a computer? Can a universal computing machine simulate every physical process? What is the source of the computational power of quantum computers? Are computational approaches to solving physical problems and paradoxes always fruitful? (...) There is a deeply entrenched view in philosophy and physics, the closed systems view, according to which isolated systems are conceived of as fundamental. On this view, when a system is under the influence of its environment this is described in terms of a coupling between it and a separate system which taken together are isolated. We argue against this view, and in favor of the alternative open systems view, for which systems interacting with their environment are conceived of as (...) fundamental, and the environment's influence is represented via the dynamical equations that govern the system's evolution. Taking quantum theories of closed and open systems as our case study, and considering three alternative notions of fundamentality: (i) ontic fundamentality, (ii) epistemic fundamentality, and (iii) explanatory fundamentality, we argue that the open systems view is fundamental, and that this has important implications for the philosophy of physics, the philosophy of science, and for metaphysics. ABSTRACT:Despite sustained attention to ethical leadership in organizations, scholarship remains largely descriptive. This study employs an empirical approach to examine the consequences of ethical leadership on leader promotability. From a sample of ninety-six managers from two independent organizations, we found that ethical leaders were increasingly likely to be rated by their superior as exhibiting potential to reach senior leadership positions. However, leaders who displayed increased ethical leadership were no more likely to be viewed as promotable in the near-term compared to (...) those who displayed less ethical leadership. Our findings also show ethical culture and pressure to achieve results are important contextual factors that moderate the relationships between ethical leadership and leader promotability to senior leadership roles. In autonomous action the agent herself directs and governs the action. But what is it for the agent herself to direct and to govern? One theme in a series of articles by Harry G. Frankfurt is that we can make progress in answering this question by appeal to higher-order conative attitudes. Frankfurt's original version of this idea is that in acting of one's own free will, one is not acting simply because one desires so to act. Rather, it is also (...) true that this desire motivates one's action because one desires that this desire motivate one's action. This latter desire about the motivational role of one's desire is a second-order desire. It is, in particular, what Frankfurt calls a second-order “volition.” And, according to Frankfurt's original proposal, acting of one's own free will involves in this way such second-order, and sometimes yet higher order, volitions. Suppose you resolve now to resist an expected temptation later while knowing that once the temptation arrives your preference or evaluative assessment will shift in favor of that temptation. Are there defensible norms of rational planning agency that support sticking with your prior intention in the face of such a shift at the time of temptation and in the absence of relevant new information? This article defends the idea that it might be rational to stick with your prior intention in (...) part because of your anticipation of regret in the further future if you were to give in to the temptation. It does this by appeal to the significance of anticipated future regret to the agent ’s present standpoint, and to the role of the agent ’s standpoint in her self-governance. (shrink)

You can sometimes have and be moved by desires which you in some sense disown. The problem is whether we can make sense of these ideas of---as I will say---ownership and rejection of a desire, without appeal to a little person in the head who is looking on at the workings of her desires and giving the nod to some but not to others. Frankfurt's proposed solution to this problem, sketched in his 1971 article, has come to be called the (...) hierarchical model. Indeed, it seems that, normally, if an agent's relevant higher-order attitudes are not to some extent shaped by her evaluative reflections and judgments her agency will be flawed. But this suggests a Platonic challenge to the hierarchical account of ownership. The challenge is to explain why we should not see such evaluative judgments---rather than broadly Frankfurtian higher-order attitudes---as the fundamental basis of ownership or rejection of desire. I do think that a systematic absence of connection between higher-order Frankfurtian attitude and evaluative judgment would be a breakdown in proper functioning. But I want to explain how we can grant this point and still block the Platonic challenge. (shrink)
